These Terms of Service govern your membership in, and use of, the MGM Select signal service operated by JMP Strategic Investments Pty Ltd (ABN 20 161 825 667, AR 329302), an authorised representative of PGW Financial Services Pty Ltd (AFSL 384713). By subscribing to MGM Select you agree to be bound by these terms in full. If you do not agree, you must not subscribe or continue as a member.
MGM Select provides a weekly signal publication, post-close alerts when signals fire, a monthly members-only briefing, and an annual signal record. All content constitutes general financial product advice only and is provided subject to the General Advice Disclaimer, which forms part of these terms by incorporation. The service does not provide personal financial advice.
Membership is limited to a maximum of 50 active members at any time. Applications are accepted at the discretion of JMP Strategic Investments Pty Ltd. Acceptance of an application does not create an obligation to maintain membership indefinitely. Membership is personal and non-transferable - it may not be assigned, shared, or gifted to another person.
By subscribing you confirm that you are at least 18 years of age, resident in Australia, and that you have read and understood the General Advice Disclaimer and the Financial Services Guide prior to subscribing.
The membership fee is $997 per month (GST inclusive) or $9,997 per year (GST inclusive). All fees are quoted in Australian dollars. Annual membership represents a saving equivalent to two months of the monthly rate. Fees are charged in advance at the commencement of each billing period. There are no refunds for partial periods.
Payment must be kept current. If a payment fails and is not remedied within 7 days of notice, membership may be suspended or cancelled without further notice.
Members may cancel at any time by providing 30 days' written notice to john.pontikas@jmpstrategicinvestments.com.au. Notice must be received in writing - verbal notice does not constitute valid cancellation. During the 30-day notice period, membership remains active and the member continues to receive the service. No fee is charged beyond the notice period. There is no lock-in beyond the 30-day notice obligation.
JMP Strategic Investments Pty Ltd reserves the right to cancel a membership immediately if a member breaches these terms, including but not limited to the confidentiality obligations below.
All content delivered through MGM Select - including weekly publications, post-close alerts, monthly briefing recordings, and the annual signal record - is strictly confidential and provided for the personal use of the subscribing member only. Members must not share, forward, republish, copy, screenshot, summarise, or communicate any content from the service to any person who is not a current member.
This confidentiality obligation is not a formality. Signal integrity in less liquid ASX securities depends on the number of participants acting on each signal remaining below the membership cap. Unauthorised distribution of signal content directly undermines the quality of the service for all members.
Breach of this obligation will result in immediate termination of membership without refund and may give rise to legal action.
All content published through MGM Select, including the Market Governance framework, signal methodology, publications, alerts, and briefing materials, is the intellectual property of JMP Strategic Investments Pty Ltd. No licence is granted to reproduce, adapt, or commercialise any content from the service.
To the maximum extent permitted by law, JMP Strategic Investments Pty Ltd, its directors, officers, and authorised representatives are not liable for any loss, damage, or cost - including consequential, indirect, or special loss - arising from your use of or reliance on the service. This includes losses arising from market movements, signal outcomes, or any decision you make in connection with information received through the service.
Nothing in these terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by any legislation where to do so would be illegal or would cause any part of these terms to be void.
JMP Strategic Investments Pty Ltd reserves the right to modify the service, these terms, or the pricing structure at any time. Members will be given at least 30 days' notice of any material change. Continued membership following notice of a change constitutes acceptance of the revised terms.
These terms are governed by the laws of South Australia. Any dispute arising from or in connection with these terms will be subject to the exclusive jurisdiction of the courts of South Australia.
